How Congress is Signing its own Arrest Warrants in the NDAA Citizen Arrest bill

I never thought I would have to write this: but—incredibly—Congress has now passed the National Defense Appropriations Act, with Amendment 1031, which allows for the military detention of American citizens. The amendment is so loosely worded that any American citizen could be held without due process. The language of this bill can be read to assure Americans that they can challenge their detention — but most people do not realize what this means: at Guantanamo and in other military prisons, one’s lawyer’s calls are monitored, witnesses for one’s defense are not allowed to testify, and one can be forced into nudity and isolation. Incredibly, ninety-three Senators voted to support this bill and now most of Congress: a roster of names that will live in infamy in the history of our nation, and never be expunged from the dark column of the history books.

They may have supported this bill because—although it’s hard to believe—they think the military will only arrest active members of Al Qaida; or maybe, less naively, they believe that ‘at most’, low-level dissenting figures, activists, or troublesome protesters might be subjected to military arrest. But they are forgetting something critical: history shows that those who signed this bill will soon be subject to arrest themselves.

Our leaders appear to be supporting this bill thinking that they will always be what they are now, in the fading light of a once-great democracy — those civilian leaders who safely and securely sit in freedom and DIRECT the military. In inhabiting this bubble, which their own actions are about to destroy, they are cocooned by an arrogance of power, placing their own security in jeopardy by their own hands, and ignoring history and its inevitable laws. The moment this bill becomes law, though Congress is accustomed, in a weak democracy, to being the ones who direct and control the military, the power roles will reverse: Congress will no longer be directing and in charge of the military: rather, the military will be directing and in charge of individual Congressional leaders, as well as in charge of everyone else — as any Parliamentarian in any society who handed this power over to the military can attest.

Perhaps Congress assumes that it will always only be ‘they’ who are targeted for arrest and military detention: but sadly, Parliamentary leaders are the first to face pressure, threats, arrest and even violence when the military obtains to power to make civilian arrests and hold civilians in military facilities without due process. There is no exception to this rule. Just as I traveled the country four years ago warning against the introduction of torture and secret prisons – and confidently offering a hundred thousand dollar reward to anyone who could name a nation that allowed torture of the ‘other’ that did not eventually turn this abuse on its own citizens — (confident because I knew there was no such place) — so today I warn that one cannot name a nation that gave the military the power to make civilian arrests and hold citizens in military detention, that did not almost at once turn that power almost against members of that nation’s own political ruling class. This makes sense — the obverse sense of a democracy, in which power protects you; political power endangers you in a militarized police state: the more powerful a political leader is, the more can be gained in a militarized police state by pressuring, threatening or even arresting him or her.

Mussolini, who created the modern template for fascism, was a duly elected official when he started to direct paramilitary forces against Italian citizens: yes, he sent the Blackshirts to beat up journalists, editors, and union leaders; but where did these militarized groups appear most dramatically and terrifyingly, snapping at last the fragile hold of Italian democracy? In the halls of the Italian Parliament. Whom did they physically attack and intimidate? Mussolini’s former colleagues in Parliament — as they sat, just as our Congress is doing, peacefully deliberating and debating the laws. Whom did Hitler’s Brownshirts arrest in the first wave of mass arrests in 1933? Yes, journalists, union leaders and editors; but they also targeted local and regional political leaders and dragged them off to secret prisons and to torture that the rest of society had turned a blind eye to when it had been directed at the ‘other.’ Who was most at risk from assassination or arrest and torture, after show trials, in Stalin’s Russia? Yes, journalists, editors and dissidents: but also physically endangered, and often arrested by militarized police and tortured or worse, were senior members of the Politburo who had fallen out of favor.

Is this intimidation and arrest by the military a vestige of the past? Hardly. We forget in America that all over the world there are militarized societies in which shells of democracy are propped up — in which Parliament meets regularly and elections are held, but the generals are really in charge, just as the Egyptian military is proposing with upcoming elections and the Constitution itself. That is exactly what will take place if Congress gives the power of arrest and detention to the military: and in those societies if a given political leader does not please the generals, he or she is in physical danger or subjected to military arrest. Whom did John Perkins, author of Confessions of an Economic Hit Man, say he was directed to intimidate and threaten when he worked as a ‘jackal’, putting pressure on the leadership in authoritarian countries? Latin American parliamentarians who were in the position to decide the laws that affected the well-being of his corporate clients. Who is under house arrest by the military in Myanmar? The political leader of the opposition to the military junta. Malalai Joya is an Afghani parliamentarian who has run afoul of the military and has to sleep in a different venue every night — for her own safety. An on, and on, in police states — that is, countries with military detention of civilians — that America is about to join.

US Congresspeople and Senators may think that their power protects them from the treacherous wording of Amendments 1031 and 1032: but their arrogance is leading them to a blindness that is suicidal. The moment they sign this NDAA into law, history shows that they themselves and their staff are the most physically endangered by it. They will immediately become, not the masters of the great might of the United States military, but its subjects and even, if history is any guide — and every single outcome of ramping up police state powers, unfortunately, that I have warned for years that history points to, has come to pass — sadly but inevitably, its very first targets.

    Excellent job, Naomi! What use could Congress possibly be to a police state? And if we go back to the rule of law as defined by our great Constitution, then they’ll be known as traitors! There is no future for those Congressmen that supported this! Just as there was no future for Hitler at the end of WW2! An old Chinese proverb states, “may you live in interesting times!” Certainly, we are today!

      With the direction things are going at the the moment, that’s a big ‘if’ on things reverting to their former constitutional stability. I think the best case scenario would be a post Nazi Germany situation, worst case could lean more in the direction of North Korea. Which isn’t such an off the wall conception. Fear is a very powerful tool which has been wielded in this manner countless times before. On the flip-side, the truth is equally powerful and I salute those like you, who keep the public informed about the truths that are obscured daily by the present regime (if you will). The only hope for the survival of our democracy is an informed, focused and unified population. It’s a very sad thing to behold what’s become of the once shimmering vision for this nation that was conceived by our forefathers.

          Democracy is not mob rule. Mob rule is carried by fear and the unknown. Democracy is carried by knowledge and understanding. Now that being said democracy can be a tool to which can create mob rule, like what GWB and Karl Rove did in 2000 and in 2004 where the uniformed, the bigoted and the haters where driven by fear which created mob rule. Democracy only works well when everyone is informed of the truths and lies of our society. The truth is our Republic, for far too long, has been under the weight of very evil men and women, specifically those who would allow harm to others. Fear is not an option Americans can afford from this point on. Fear creates mob rule and the GOP knows it. Put them all in jail. Don’t forget those blue dawgs too.

            Democracy IS mob rule. Before you respond to debate someone, you need to know everything on a subject matter. You obviously don’t.

            Democracy has been long known as the gate to Socialism. Communism, Fascism, Nazism, Communitarianism, are all Socialism simply by definition of the big government.. Our founding fathers gave us a Constitutional Republic (if we can keep it). A Constitutional Republic is by Rule of Law as opposed to a Democracy where Social Justice and Collectivism of the majority equals Mob Rule and ushers in Communism or Fascism. Same thing… in one, owner of all is government. In the other, government is in bed with monopolies. See Mussolini and then Hitler. 100s of millions of people died bcs of one Socialism or another.

            @SaSSantSo: Completely agree with you! Our Constitutional Republic was designed to allow us to be ruled by laws not by men. Our Constitution was created to limit the government actions. The term “democracy” is preferred, however, by those in power, because if the people can be terrorized by everyday crimes or false flag events, then it’s known that theyll be willing to exchange freedom for security. If the people have an internal restraint, like a peaceful religion or strong morals, then a democracy can be an open, free society. But, in a society without internal constraints, that democracy slides toward a police state. God has been marginalized for decades in this country and that internal constraint has been removed. More than even the “right laws”, we need for our country to be healed and restored with God. I’m not giving excuses for the crimes committed by the Feds. But, we can’t blame every horrible crime on them. We should also face the reality that pulling God out of the schools, government and our daily lives has not given us any freedom.

            Are you implying that this is the work of the Republicans, and that the Democrats fought it?

            Also, democracy is rule by majority and does not imply any specific rules or safeguards of individual rights. It is mob rule, and the “knowlege” that fuels it is propaganda.

            Ben, I certainly believe that there is enough blame to go around, but I do disagree with you on some points. I’ve read where some of our Founding Fathers described democracy as one of the most damnable forms of government ever created. When I was a boy, I cannot remember the word democracy in the pledge of allegiance. We are/were meant to be a Constitutional Republic. This next part is where I feel that “they” get us every time. I believe that there are very powerful people that have created an us versus them type of mentality. Whereas the real truth is that these powerful people control both the leaders of the right and the left. We end up polarized, fighting one another, either listening to people like Limbaugh and Hannity or listening to people like Matthews and Oberman. When in truth, both groups are owned by the same powerful men and women who steal from us our birthright as free men and women. It would be like the passengers on the Titanic arguing with one another about something as trivial as the color of the curtains in the dining room. And we have to stop voting and behaving like people supporting their favorite sports team. We can all see how both groups are attacking someone like Ron Paul. The TV networks of both groups oppose him. Both Faux News and MSNBC. Not to mention ABC, CBS, NBC, etcetera. We have to all wake up and break free of our “mind game” shackles.

            Democracy is mob rule. It is a shame that people in AMERICA believe this. We do vote similiar to a democracy but we also have a bill of rights to protect us against mob rule. These rights cant be taken away by majority(mob) rule of 51% per the Constitution. They are inalienable rights given to us by god. A full democracy turns into social democracy which we have become. With the laws that keep passing we will soon if not already be socialism on the way to communism. GOD PLEASE SAVE the REPUBLIC!!!

            Let me settle the argument plain and simple. In the Greek language: Demo means “many” and can also be interpreted as “mob”. Cracy translates as “rule”.

            The Greeks invented democracy. The foundation of the so-called and commonly referred to democracy of the United States (not America) is premised on the ideals and principles of Greek Society, which concluded that the ordinary citizen achieved the right to partake in the political process by influencing the political direction of the country through a vote of conscience–unless you were a woman, servant, slave or foreigner (then you had no rights). This is democracy. It is an ideal which has no association with that of being knowledgeable, but only the deficit of it.

            Nowhere is democracy mentioned in the US Constitution, let alone the Bill of Rights. We live in a republic. “I pledge Allegiance to the flag of the United States of America and to the Republic for which it stands…” Not to the Democracy! Republic is defined as “against the crown” or against the monarchy.

            Democracy, used to divert attention, has been sold to the public.

            Sadly, our forefathers knew something that many US citizens of today are not aware of. The purpose of the US Constitution is to confine or limit the will of a democracy, because historically democracies have led to a small elite class ruling the majority. For example, you elect officials to serve in the Senate and Congress, and you select the person you see best to serve as the president. You do not vote to pass federal law, your representatives do this. In such a democracy, you relinquish your power to a higher authority.

            In addition, businesses usurps the influence of the citizen’s vote by hiring lobbyists to sway the thinking of politicians by way of threat or the offer of prosperity. The politician votes on behalf of the business, unless he or she feels at risk of not being reelected by the citizen. Whether you like it or not, a corporation is considered to be a person and it is entitled to the same constitutional rights that are afforded to the US citizen. Refer to the Bill of Rights: 14th Amendment ; and “Personhood” defined in Supreme Court documents.

            Naomi’s view and analysis of the recent legislation represents one of many possible outcomes. Regardless if you agree with her or not, or you encounter someone who has an opinion unlike hers, there will be in all inevitability a common denominator: the decisions made to pass this act were decided and condoned by the President, Congress and Senate “the ruling minority” and not by you.

            The recent uproar is the result of the act in violation of the US Constitution and the Bill of Rights, not by blatant description but by the vagueness of definition within some of its passages, which allows room for manipulation.

            To all the posters who are saying, “We are not a Democracy, we are a Republic!”, you are correct that we are NOT a Democracy, but you are wrong (sadly!) that we are a Republic. The Republic is dead. D-E-A-D. The Constitution is dead. OK, I know — no one wants to admit it, everyone says, “If we can just return to the way the Founders planned…” Well, it is not bloody likely to happen, because most Americans do not want the Republic back. They would rather have Social Security, they would rather have an Empire, they would rather have a King who serves in four year investments.

            I am sorry, I really am VERY sorry, but the days of the Bill of Rights and the Republic are over.           Duke, We were indeed founded as a Republic but when one looks back at history, you’ll find that it ended around the middle of 186. After the War Between The States we have been left with a democracy. The two party system isnt a Republican form of government. In a Republic the Constitution is strictly enforced. Only those powers that are delegated to the Federal Govt are followed. Today, the Federal Govt believes it has supreme power of the States etc… That is not how the Constitution was setup. Federalism is dead.

When they converted to a democracy, they promptly imploded. There is a big difference. FDR was the first to coin the term democracy.

          I am grateful to you and many others who are now trying to open the eyes of our fellow brothers and sisters who call this section of the earth; “home”.

          I was once where the Democracy espousing ignorants reside. I was
          lucky enough to be educated otherwise. I find that many of those who
          embrace democracy believe it to be the same thing as a Constitutional
          Republic. Their hearts are in the trim, they just need some guidance
          on legal and governmental terminology.

          Be patient and understanding but point out to them how beautiful a
          Constitutional Republic is. We can be the beacon of the world again.

          It’s just a matter of “think smarter not work harder” and out-thinking them with strategies and tactics.

          I’ve been informed by many people a lot smarter than me that they’re working on multiple strategies, tactics, plans etc to switch the “power base” back to the 99% and it’s most encouraging.

        And that sentiment, in a nutshell, is why it will be incredibly easy for Obama or a future president to have Congressional leaders arrested and held indefinitely. A public that is so easily demagogued to see their own representatives who are engaging in open debate as “hostage takers” and “terrorists” will not blink when they are arrested on allegations of treason or bribery or incitement. Obama is the first president to suggest that Congress is not only not doing it’s job, but is trying to destroy the country. His solution in 2012 is to simply ignore them. But next year he may decide he wants to exert “non-political” pressure.

            What is Kooky about a person that sticks to the constitution more than his party has in decades or what is kooky about a principled congressman knowing more about peace and civil liberties than a supposed constitutional lawyer candidate of hope and “change”?

          Please explain why Ron Paul is a “kook.” As far as I can tell he is the only candidate standing for the Constitution, keeping us out of foreign wars we can’t afford, exposing the Federal reserve and danger of fiat money. He values innocent human life, (consistently), believes in state’s rights (tenth amendment), and U.S. sovereignty.

      Many Representatives and Senators have said this, and most recently John Insane McCain, that this is x-number of presidents
      he has “served under”. When members of Congress declare that they serve “under the president”, that statement alone tells you how irrelevant and useless they are.

      We still need to “vet” him but, he looks like the “real thing.” He’s already waged an incredible battle against the government and their evil ways. You’ll be amazed at what he’s done so far. I have no affiliation with him or his web site or company but, it’s very very encouraging.

      He’s had some set backs but, that’s to be expected when you fight the US Government and all three branches are in collusion.

      It looks like he just needs a bigger support group to give him “bigger guns” and maybe he can do more.

      Americans deemed by President Obama as Belligerent are vulnerable to Arrest and Indefinite Detention under the passed NDAA, National Authorization Defense Act.

      Recently the Obama Administration asked a NYC Federal judge to (stay) suspend a ruling by a U.S. District Judge (Katherine Forrest) that permanently blocked enforcement of vague provisions of NDAA that give the President authorization to lock up belligerents indefinitely. According to the Obama Administration—they (were justified) to lock belligerents up indefinitely—because cases involving belligerents directly-aligned with militants against the good of America—warrants such punishment.) Obama may use the NDAA provisions blocked by U.S. District Judge (Katherine Forrest) to round up without evidence millions of Americans alleging they are belligerents or threat to National Security. Hitler included similar provisions in his fascist (Discriminatory Decrees signed February 28, 1933). Immediately after German Parliament passed Hitler’s laws, the Reich Government ordered the arrest of German Citizens without probable cause or evidence; delegated power to German Police and other authorities to arrest anyone Nazi authorities claimed attempted or incited public unrest: arrested among others were outspoken Germans, writers, journalists, peaceful protestors and artists. After World War II the East German Secret Police (Stasi) used the threat of Indefinite Detention to forcibly recruit thousands of informants.
      The U.S. 2012 NDAA legislation Obama signed 12-31-11 is similar to Hitler’s 1933 fascist laws the SS and Gestapo used to target persons in Germany for arrest, imprisonment and execution without probable cause; and confiscate millions of dollars of property. Then Hitler used his laws to suspend Parliament insuring his laws could not be rescinded.
      During the Obama Administration’s recent request for a (stay) to stop U.S. District Judge Katherine Forrest blocking enforcement of vague NDAA provisions, the Federal Government—never clarified what constitutes a (belligerent); or militant; or what belligerent activities (directly aligned with a militant) to order a belligerent’s arrest or indefinite detention; or what is against the good of America. Under NDAA, the U.S. Government or President could claim anyone was (directly aligned with militants) e.g. any political or other association; charge any activity, statement, writing or communication was (directly aligned) with an individual or group the government deemed (militant) to arrest and indefinitely detain Americans. Writers, journalists, Americans that disagree with or question U.S. Government or its allies—may under NDAA be subject to arrest and indefinite detention.
      The 2012 and not yet passed 2013 NDAA, like Hitler’s 1933 Discriminatory Decrees allow forced government censorship; warrant-less searches of private property and forfeiture of property from persons not charged with crime. Provisions in 2012 NDAA keep the door open for corrupt U.S. police; government agents and provocateurs which there are many, to falsify reports and statements to target any American, group or organization for arrest, indefinite detention, complete disappearance; civil asset forfeiture of their property.
      You may have noted NDAA referred to the USA Patriot Act. Under the Patriot Act, lending itself to Government / police corruption, the Federal Government may use secret witnesses and informants to cause arrests and civil asset forfeiture of Americans’ property. Witness(s) and informants may be paid up to 50% of assets forfeited. Federal Government under 18USC may use a preponderance of civil evidence, little more than hearsay to Civilly Forfeit Private Property. Under the Patriot Act innocent property owners may be barred by government knowing the evidence federal government uses to forfeit their property.
      Sections of 2013 NDAA are so broad, it appears U.S. Government or the President could (retroactively) deem an American’s past 1st Amendment activities prior to passage of 2012 NDAA—supported hostilities, terrorism or (Belligerents) to order the arrest and Indefinite Detention of any U.S. Citizen, writer, group or organization.
      Under NDAA It should be expected that indefinitely detained U.S. Citizens not involved in terrorism or hostile activities, not given Miranda Warnings when interrogated, not allowed legal counsel or habeas corpus may be prosecuted for non-terrorist (ordinary crimes) because of their (alleged admissions) while held in Indefinite Detention.

    We need to educate people within the intelligence, police communities, US citizens (the 99%) that we need to investigate:
    1. the real perpetrators involved in the terrorist attacks of 9/11, London 7/7 and other contrived “strategy of tension” terror attacks designed to instill fear and provide the pretext for the police state;
    2. who are connected to the MSM “usual suspects” who continue to fan the flames of the so-called “war on terror”, the Muslim boogie-man (destroy Palestine) agenda;

    4. who are part of the same criminal groups pillaging the tax-payers, profiting from the “war on terror”
    5. who are part of the the same group of fraudsters using DHS grants to spy on and criminalize those opposed to them;
    6. who are connected to the corrupt politicians who propose, advocate legislation criminalizing the freedoms necessary to determine the identities of this same oligarchic clique now pillaging the world one nation state at a time, and transforming the world into a global gulag.

    So, Why don’t we just identify the individuals within these groups, and throw these people in jail, rather than round up the American citizens opposed to this criminality?

You cant expect them to admit their grievous mistakes and actually take responsibility for them can you?         Right now the 2nd Amendment stands on a slim majority in the Supreme Court. If the makeup of the court changes during the next presidential term (which is likely to happen) then we could see the 2nd largely abolished depending upon who chooses those justices.

        I would suggest any and all become very informed on EVERY canidate’s position concerning the 2nd Amendment and then choose who you vote for very, very wisely.

    You know what really troubles me is that I’ve been reading “The End of America” right now, a book which is written in 2007 and literally ALL of Naomis assumptions for the future are point blank. Just to mention two examples she literally stated that “people will be accused of enspionage for the publishing of documents deemed secret” (Wiki-leaks affair?) and that facist governments use “situations of economical crisis and public unrest” to get into power, which back in 2007 was not the case. Well lets just hope Ms. Wolf goes wrong for once or else in the next 4-5 years it is good bye American Democracy, hello facist Superpower with the largest military in the world and the desperate need to get out of economical crisis.

    Interesting thesis, but Mussolini didn’t exactly have enabling legislation working for him when we turned his thugs loose. From what I understand about Russian history the same is true. If our military found it necessary to intervene in government I’m guessing they’re not going to be too concerned with having legal cover. That’s easily enough invented.

    This is where the 5th Amendment to the U.S. Constitution steps in. It says,

    Please help me understand how this language, which specifically prohibits American Citizens from military detention, allows for the military detention of American Citizens. I don’t understand.       I’m with you, David. I’ve read all the same things as you and I can’t find it in there anywhere…It doesn’t expend POTUS’ powers, either. I keep asking all my more-politically-informed friends of mine to show me where it possibly can be construed to get me locked up, and NOBODY can find it – they just send me links to talking heads (liberal AND conservative) saying how our Bill of Rights is now gone…

        How facts and evidence do you need to think ‘would the USA secretly arrest its own citizens?’.
        Have you ever asked the IRS to disclose the facts-evidence-witnesses alleging that you are required to pay a income tax? Or do you simply pay (too lazy or afraid to demand the truth) to avoid a gun being pointed at your head while the IRS watches the Sheriff sell your home?
        The ‘bill of rights’ has been gone for over 100 years…

      I am thinking the requirement to be met to detain those who are not US citizens is not needed to detain US citizens, therefor implying that there is no actual requirements to impose this to US citizens…..I hope I am wrong.

      The key word here is “requirement”. It is not required, however, it is PERMITTED. For example, I don’t require my children to wear tennis shoes, but I do permit them to. To keep this from applying to American citizens, the statement should have been written to say, “The permission to detain a person in military custody under this section does not extend to citizens of the United States.”

    This has been reported in Australia too. The Act gives them power to arrest anyone anywhere, not just US citizens on US soil. Why they think this will fly in other countries is beyond me?

      This is what happened to the President, he’s not flip flopping, he’s being tactical. I think he weighs everything out. Here me out. We are global and connected now. People are waking up from the wars, the bigotry, and the hate. We have a list now of those who would do harm to our country and our constitutions. I’m very sure the military answers to the President, Commander and Chief to whom his very respected among those in higher ranks. We have an opertunnity to watch and/or participate in the largest round up evil you have ever seen. Imagine this, life is easily measured just by opening your eyes and seeing who has cheated and who has suffered. These men and women who signed this Bill will see prison time along with many others who have exploited our system of government to benefit their own lives. I’m seem to recall Lincoln removing habeas corpus to those who stood against Democracy.

    In response to those who are misreading the text of the bill here: “The requirement to detain a person in military custody under this section does not extend to citizens of the United States”. This means that the military is not REQUIRED to detain citizens. It does NOT say that they may not CHOOSE to detain them. Therefore, they MAY detain them. They have the legal right to do so, which is the entire problem in a nutshell.
    Other than this placing everyone in an impossible position of vulnerability, I simply find it to be so depressing as to result in me wanting to leave the country. The emotional impact of the behavior of these people to whom we entrust our country causes immeasurable damage to our morale. This type of betrayal creates a spiritual ‘damage’ that effects the fabric of our beings. Anyone else feel like this?

    @Robert: The NDAA can be used to make anyone, anywhere just disappear. To think that there could be any comfort because it doesn’t seem to apply to you is ludicrous! What judge would you argue to? What lawyer would you have access to, to prove that you’re not actually in that category? When you disappear, your disappearance will be treated just the same as any other! And, it’s my understanding that the section in the bill that doesn’t “require” Obama to use the military to detain American citizens is put in there to ALLOW him to use state and local police. Any notion that this bill provides security for anyone but Obama is pure folly!

      @ Jeff – the fact that this could be abused does not mean that it will be, or that abuse could succeed. The court of public opinion is the last resort in all cases, including this one. Should the government start to detain people who are in no way associated with Al-Qaeda or Taliban, then we will have the power to stop it. Bush was not able to go as far as he wished in restricting people’s rights because of popular and legal opposition, even by the Supreme Court. Let us not strengthen our opponents by imagining their power to be greater than it is.

      Obviously you need a dictionary.

      The key word here is “Requirement”(look it up). The exemption above removes citizens from the REQUIREMENT of indefinite military detainment. In more words, they can still indeed be Militarily detained based on the King’s..I mean president’s order, or they can be passed off to the civilian courts by his order to. It all depends on the Executive..not the constitution.

      Read carefully. Any good lawyer can argue that while military detention is not REQUIRED of citizens, it is NOT OUTLAWED. Military detention, therefore, remains a legal option under this law.

The Democrats hate him. The Republicans hate him. The corporations hate him. The establishment media hates him. They all freaking come unglued when it comes to him. Why? He makes them look like the hypocritical frauds each and every one of them are. Yes, the left and right hate each other, and yes, they fight over who gets control of the trough, but someone like Paul, who wants to drain the swamp, has them lock-and-step in arms united against him.       As an American Citizen that’s 52 years old, and served in our military for our country and a husband and a father with many kids, this is the saddest day of my life!

      I’ve never liked history and I’ve never liked politics. I played sports, tried to date lots of beautiful women, drank, partied and did all the foolish things that young men do.

      But, as I got older and got married and had kids and started paying attention to the important things in life, my eyes started to open and my ears started to listen and my brain started to understand.

      My second son actually started me on my path to enlightenment when he came back from college. He started sharing articles and YouTube videos of shocking things that we’re going on “behind our backs” by our government. He shared his opinions with me and started me thinking about “right and wrong”, “left and right” and the “hidden agenda.”

      Ever since that day about a year ago, I’ve been on a 24-7, 365 day information hunt and I’ve literally “lost my breath” every day as I’ve learned about the “great ponzi scheme” and con-game that has been employed upon the American Citizens by our government. I’m sick to my stomach! I’m embarrassed and full of shame that it’s taken me this long to uncover the amount of evil that is being used against us every day! I’ve cried, I’ve thrown things, I’ve said so many swear words that my kids are getting concerned and the love of life is worried about my well-being.

      After my emotional and intellectual awakening, and the shock to my system, I’ve calmed down and have sworn a private pledge to my “maker” that I will live the rest of my days doing something positive about this.
      Why?
      Because I hate bullies with a passion and I want a better life for our kids!

      Do I have a “plan” that can help all of us?

    Newspapers reported that Obama signed the legislation “with reservations.” What few reported is that his reservations were because the bill gave too little power to the executive branch. Occording to the bill’s sponsor, it was Mr. Obama who demanded that language exempting US citizens be removed.

    The last president to claim such powers was Abraham Lincoln. He arrested journalists, legislators, and even Supreme Court justices who ruled his actions were unconstitutional.

    The Constitution deals with Habeas Corpus in a section outlining restraints on the legislature. It says Habeas Corpus may only be suspended during times of rebellion, invasion, or at times when the public safety may require it. If I could take a red pencil to that document, I would strike out everything that follows “shall not be suspended.”

    Recently the New York Times gave a list of questions to all the presidential candidates about their views of the limits of power of the executive. All the GOP candidates except Ron Paul (of course) gave shocking answers. Obama declined to answer at all.

      The courts have been the biggest failures. Unpopular judges have met their fates in the past.

      Besides, Congress has a final say. Modern Judges have interpreted the Constitution to appease Congress time and time again. Not in all cases, but those that they understand really matter to Congress and can have repercussions for their careers as judges.

      In my view, the judicial branch is the one who has failed us the most. Especially when they “interpret” the Constitution to help Congress “amend” what they clearly can’t under that part of the Constitution which they base most of their “interpreted” rulings on. They do this to make it easy for their masters in Congress. When was the last time Congress was forced to amend the Constitution because of a court ruling or were forced to over a court ruling?

      I rest my case.

      Not making too much fuzz is how you pass unconstitutional laws, this way they don’t rouse the sheeple (like the sheeple can be roused).

      On the Julian Assange case, it is even more telling, they think they have all the facts? Let me tell you, in a “she said, he said” scenario, you don’t (which is why the idea of using that case to extradite is an extreme stretch), especially if it is the state who went out looking for something to charge you with. They seem to not mention that those accusations were once dropped, then picked-up again when the U.S.A wanted to get back at Assange.

      Curious, one of the women claims she had awoken to find him having unprotected sex with her. I have had sex before, you know, never had an instance when a woman was so comatosed she couldn’t feel me. What are kids taking these days?

      So let me get this straight, the people at Salon want me to believe, with a straight face, that this case has merit, with no evidence, even though it “may have a political” end game and that Wolf should provide proof of her analyses of the situation?     Excellent piece! I have read The Confessions of An Economic Hit Man, an absolute page turner. I think you misinterpret his role slightly. Perkins was not a “jackal”- this was the CIA’s role, only deployed when Perkins could not secure a proper result–i.e. Phase II…

    Also, Perkins did not discuss in the book that he worked with “Latin American parliamentarians,” rather that he was working with the leaders of Latin American countries. Of course, it is likely that other consultants working with key members of Parliament as you describe- but Perkins only discusses his dealings with the leaders of these countries.

    This is presumably, then, a lesson for Obama- who celebrated the New Year by signing this bill into law. However, looking at the world through the lens that Perkins provides, one can clearly see that all leaders have been quite compromised for a very long time. Our “interests and obligations” are comprised of a team of corporations who, colluding with government, seek to dominate the globe- and will use any means necessary to achieve that goal.

    When I read the title, I laughed out loud because it’s so ironically true – they really might as well have signed their own arrest warrants. And I’d bet $500 that didn’t occur to a single signer.

    Then I read the rest of the article and got sick to my stomach.

    I haven’t had hope for this country as is for a long time. But I did figure that the way it would eventually shake out would be: bankruptcy of the federal government, a strong secession movement by a majority of the states, and a likelihood of minimal to no bloodshed. Then a chance to rebuild liberty in some few of the states or an alliance of them.

    If, however, the military assumes the kind of control Ms Wolf foresees, there will be no bloodless secession. If there are attempts by states at splitting off, they will be met with massive force and bloodletting. I literally want to throw up right now at the thought of how much death we will see.

    I hope you’re wrong, author. But I suspect you’re not. Your article rings true. If Mr. Paul is not elected – and, my friends, despite his Iowa showing, that’s still very, very unlikely – I fear the worst may come to pass in just a few short years.

    Thank-you for the articulate “post” on this very very very serious problem.

    That being said, I’m curious why you don’t suggest solutions to this problem that we face. You have the readers, and you’re very intelligent and “well-spoken” but, American Citizens need ideas and concepts so we can attack this “head on.”

    I’m curious, if you made suggestions, would it make you liable in any way or are you concerned that the government will contact you or is it something else?

    If we don’t start working on solutions as a “team”, as a group of connected American Citizens, we can’t do anything. “They” have the “guns” and they pick on individual citizens because most people don’t have the will power or the money to “fight” alone. They know that and it’s one of their strategies. They also use the law against us every day (ie “verbal and written contracts”) to trick almost all Americans! 99% of American Citizens don’t have any idea this is going on and WE NEED TO SPREAD THE WORD IMMEDIATELY!

    My feeling is this: almost everyone in Washington is a LAWYER! That’s not a coincidence. Our Constitution and Bill of Rights are a legal document called a “trust.” In order to take advantage of citizens, it helps if you’re an attorney and then you know how to “twist” every word in our Constitution to trick our Citizens.

    HOW DO YOU FIGHT A FIRE? You fight “fire with fire!” So, we need to educate everyone in the Country, especially our young people, on the basics of the law. IE: are you aware that when you’re stopped by a police officer, it’s critical to know exactly what to say and not to say because if you don’t, the officer “tricks you” into giving up your constitutional rights! Then, when you go to court and go before the “Commissioner” (who, by law is supposed to be a magistrate per our Constitution so they’ve already broken the law) you’ve already lost because you’ve said the wrong things to the officer and signed documents that you shouldn’t have signed. It’s happened to all of us, including my son and myself and it’s an outrage! If I would have known the law then, I could have fought for my Constitutional rights!

    THIS IS THEIR STRATEGY EVERY SECOND OF EVERY DAY! Threaten and threaten and threaten and intimidate and intimidate and intimidate AND THEN, trick everyone by twisting our legal laws so you have to hire an attorney to “save yourself” from the system!
    WE MUST STOP THIS AND GIVE US, THE CITIZENS OF THIS GREAT COUNTRY, A FIGHTING CHANCE!
    They want to “wear us out” and make us docile by doing this to everyone every day! There are many other examples that Citizens need to know about (marriage licenses, title to your car etc etc) No wonder no-one wants to fight back, they’re exhausted, scared, depressed, tired, and worn out because of the tactics of the “state!”

    If we group together we’ll “fight” and win. We must “fight” in a non-violent and peaceful way at first because that’s the right thing to do, it’s in our Constitution (Redress) AND it will put us on “the higher moral road.” If we can’t solve the problem like that at first, then we decide if we want to changer our strategies and tactics. We have some incredibly strong strategies and tactics if we work together and work smarter, not harder.

    I’ve found the following web site very helpful and encouraging and correct me if I’m wrong, I believe you know them or they know you. Mr. Schulz seems to be very intelligent, very intellectual, knows the law and the Constitution and is doing everything correctly as we fight this fight.

    Just look at Ron Paul’s run, and like him or not how the media with a global soap box has sought to destroy him. That is not journalism, it is government approved propaganda, protecting the internal power structure. In a Republic the government using the media as a propaganda tool against its own people would be a violation of law, today it is called reporting.

  112. Policy development arising out of “false flags” events and the narratives which misdirect our attention from those who committed the “false flags” events takes advantage of fears for safety. Those who are bamboozled to think that it is muslim extremism that we are being protected from will welcome the shredding of our Constitution and destruction of our liberties.

    If not for 9/11, Wolf and Schultz would not have their acclaim and supporters. Yet, both “protectors of the Constitution” avoid mentioning the connections–and especially avoid the obvious facts that indicate 9/11 was an orchestrated “deep politics” event used to justify the laws we are concerned about.

    Now, for another period of crickets chirping as the Pandora’s box stays essentially closed in these discussions.

    Okay, so what do we do about it?

    Reviewing the problems is just the beginning. We all need to make suggestions on how to solve the problems.

    For Example:
    The Problem:
    Everyone attacking Mr. Paul with lies and propaganda.
    I watched it last night on Fox news. What an embarrassing debacle of reporting. Every other word out of the host’s mouth was something that put Mr. Paul down. It was outrageous and even a ten year old could see what Fox is doing. Every program “slammed” him even though he is the only one with any common sense and solutions to our critical problems.
    I thought that all media was supposed to be neutral!!??
    How naive of me right?

    The Solutions:
    What about our own web site that either takes the actual video of the news (must be careful about copyright & SOPA) and put the Fox video on the left side of the web page and on the right side of the page, have an “expert” debate what was said.. ie state the truth.
    If we can’t use the actual video footage, then type up the exact words that were said (I believe that’s legal, check with an attorney) and give the rebuttal and facts on the right side. We must use facts, facts, facts because opinions won’t work.
    I believe there is a web site like that already but I can’t remember the name.

    Another Option:
    Use “peer to peer” to spread the “real news” and “the truth”. You send the info out to different “servers” around the world for protection (like WikiLeaks does) and then you can document the lies and then state the truth.

    Ideas like this will keep our society free and help stop the propaganda. Talking is a great first step but, action must be implemented next so there is hope for the “99%!”
    “We”, the 99% will always have the power and strength (1% – 3 mil; 99% = 300 mil) and we have some really powerful weapons to stop the corruption along with our guiding principles The Constitution but, everything that our Forefathers fought for will be lost if we don’t act.

      The “key” or “tactic” is to do everything in a “person to person” plan so we keep everything between family and friends and everything “low key” and OFF THE INTERNET.

By the Congress signing this they have made the federal govt illegitimate and a criminal organization whose crime is TREASON against the Constitution and the intent of the Declaration of Independence. Citizens now should act accordingly and when they leave threaten us then our defense becomes to make our own seizure and arrest of each of them. We the People are not beholden to the military for justice.

    The timetable for all out Civil unrest and revolution depends on when the first patriot falls to this Bill.

      Just for clarification and intellectual debate, there are two basic meanings for the word anarchy (please look at wikipdeia)

      1. The one that most people are familiar with and it has to do with destruction etc.
      We don’t want this one of course.

      2. The other is very positive and has to do with a form of society WITHOUT government, or at least just the basics.
      It’s a very interesting concept and open for lots of ideas and concepts.

      As for your statement that we’re headed towards anarchy under Ron Paul, I believe the 2nd definition of the word would be a great improvement.

      If you’re talking about American Citizens destroying things etc, I can’t understand why you would state that if you look at Mr. Paul’s plans on his web site.

      Furthermore, the foundation of our freedoms and liberties are built on everyone taking responsibility for themselves.

      Granted, the “switch” to a smaller form of government and less “evil” will be a tough transition but, keep in mind that the changes Mr. Paul wants to implement will immediately or very quickly put more money in everyone’s paychecks because of the reduction in military costs, elimination of the Federal Reserve (which is the evilest thing that humans have ever invented and the root of all our problems).

      Something to keep discussing that’s for sure.

      * Stalin took away gun rights, 20 million died!

      I can state approximately 5 to 10 other countries that did the same thing and the systematic elimination of citizens began!

After seeing how the United States is irrevocably sliding into FASCISM, I convinced her to go for the SPANISH citizenship instead.     US Federal Courts.
    If the Federal Courts APPROVE as “Constitutional” this ilegal “law,” it won’t be long after that even that they too will be “detained.”
    They will have NOTHING left to do, like protecting the Bill of RIGHTS.
    They too, if they act foolishly, will suffer the same results as will come to the US Congress.

      Why would they, with all their so-called education, wisdom and experience etc, approve and authorize something that is so clear and concisely written in The Constitution by our Forefathers that even a 10 year old can understand it?

      There is one reason: they have been threatened and blackmailed by others.
      It’s the only thing that makes sense, especially after reading thousands of articles and thousands of legal case laws and watching thousands of videos from credible sources and wathcing the news etc etc.
      It’s happening RIGHT NOW in our courts across America and the evidence is overwhelming and shocking.

      The courts are in collusion with the other branches of government and it’s proven on a daily basis by other citizens.
      The Judges etc are breaking laws on a daily basis to keep control of all the lies, especially the “great lie” regarding taxes.

      Think about it for a second, how easy it is for a “thug” to walk up to a Judge or Politician and say “if you don’t do ????, we’re going to kill your wife of kids and we know everything about them… when they go to supermarket, where your kids go to school, we have your bank accounts and can close them instantly” (another reason to go back to gold and silver like the Constitution states)

      That’s so easy to do in our society and no one except the wealthy, who have the discretionary money, can protect themselves.

      We have a lot of work to do but, we must push forward and “fight the evil” every day and set an example for our kids.
      We have some incredibly powerful strategies and tactics to beat “them”.
      It’s not that hard, we just need to “work smarter, not harder” and coordinate in private.
      Watch every word we say, watch every thing we do and use common sense.
      There are others who are fighting the fight via “Redress” as stated in the Constitution and that’s good, even though the evil bastards are illegally ignoring every attempt at “Redress.”

      We have ways to beat them legally because we the Citizens of the US own the “legal trust” known as the Constitution and every politician works for us and they committed treason, perjury and sedition because they “contracted” with us (citizens) because they gave us an oath, which is a legal verbal contract.

      I seriously believe that none of them realize what they did when they gave their oath and didn’t contemplate the repercussions if they “broke their contract” with the US Citizens.
      Then again, they probably knew and just didn’t give a dam because they’re so arrogant.

      We the Citizens have the RIGHTS, our “managers” aka politicians, have “PRIVILEGES”, which we assigned to them.
      They need to study the law.

      If the “Redress” strategy doesn’t work, I am predicting that the American Citizens are going to organize and file charges against the President and the people in Congress that signed the National Defense Bill for Treason, Perjury and Sedition.

      When that happens, I’m going to be very worried about the safety of my family, the safety of all American Citizens and the future of our incredible Republic!
      Will it start World War III?
      Will the gov start putting citizens in the hundreds of FEMA Camps that they’ve been retrofitting?
      They have the “legal” right now to do that because of our evil president.

      He seems very organized, very intelligent and well versed in the Constitution and Constitutional law.

      He’s growing quite a powerful following and in this fight, we need to work in large groups to stop the “state’s” illegal acts and their tendency to bully, threaten and intimidate the individuals (typical bully right!!??)
      Mr Schultz has already filed about ten different “Redress” statements to the government. Please see the info on his web site and read them, they’re very very detailed and well written and spell out all the illegal activity that our government has been doing over the years and currently.

  131. I’ve followed Bob Schultz for about four years. He is very well versed in the Constitution, in procedures of redress of grievances. I believe it was June 30, 2008 that ALL members of Congress were served with a seven-point grievance that was extensively documented. Nothing came of it–to my knowledge.

    Watch the new documentary, A NOBLE LIE about the Oklahoma City bombing. This is the kiddie pool before jumping into the deep end, 9/11 lies. The enemies are inside the gates. We all know this. That Bob Shultz and Naomi Wolf won’t go there indicates the problem of finding advocates and allies is even greater than we might imagine.

    Consider that we are being led to a “solution” that cannot address the treason of 9/11–and that those who really did 9/11 and who control the media/Congress/banking are making the plans. Consider the possibility that Wolf and Shultz are part of that plan.

      The evil “national government” is doing everything they can to stop legitimate citizens, aka the citizens of the “federal government”, from following the Constitution and Bill of Rights, that’s for sure.

      I’m confused on your comment about Wolf and Shultz.
      Are you hypothesizing that Mr. Shultz is actually part of the problem, even after all the work he’s done “Redressing” our government?

      I understand that everyone needs to be “vetted” and “wolves masquerade as sheep” many times but, I don’t see any evidence “yet” of any collusion.
      What facts are you using to make that conclusion or statement?

      Dr. Kendrick, I would like to respectfully make a suggestion please if you don’t mind.

      It’s plain to see that the atrocities that happened during the 9-11 are very upsetting to you in many ways and you’re committed 110% to righting this injustice and bringing the perpetrators to justice…. and that’s a noble and just cause and I commend you for that a million times over.

      But, as an intelligent and educated man, I would like to suggest a different “path” for you to take and still be able to accomplish the same goals and objectives that you’re seeking.

      At the moment, as you very well know, there is a “larger picture” or “bigger problem” that we’re facing and fighting.
      The 9-11 tragedy is only “part” of that larger evil. The evil we’re fighting is working on a goal that is much much more encompassing and if it’s accomplished, will make 9-11 just a “side note.”

      My challenge to you is this: we need dedicated and motivated intellectuals like yourself to work with other dedicated and loyal citizens of the US to use all of their energies, intellect, resources etc. to fight the “new battles” that are already happening and about to happen.
      By doing this, you’ll get “two birds with one stone” at the same time.

      There are millions of citizens that understand completely what is going on every day and how their rights are being trampled and how evil the government is etc etc. but, they need leadership in order to help them “find the right path.”
      With your passion and dedication, combined with your doctorate (I’m not sure what your doctorate is in) you could really help a lot of people by talking about other topics and subjects other than just 9-11.

      FOR EXAMPLE, I HAVE A SICKENING FEELING ABOUT THE FOLLOWING THOUGHTS THAT I’VE HAD.
      Please follow my “train” of thought and see if you agree with the “trends” that are appearing (feedback from others is welcome):

      * America owes $16 trillion & pres is having Fed borrow trillions more almost every other day!
      * Americans lost trillions of dollars of value in our money since 1913 because of Fed and inflation.
      * Americans lost trillions in housing values!
      * Americans lost trillions in stock market!
      * Americans lost billions because gov bailed out banks!
      * Americans lost trillions because Fed gave secret loans to banks around the planet!
      * Americans lost millions of jobs and trillions in income!
      * Americans lost trillions in wars and thousands of innocent lives!

      * When a lender loans money, they usually ask for collateral, and if the borrower can’t pay the lender forecloses on the collateral.
      * When a Sovereign Nation borrows money it’s different, there is no “real” collateral, the collateral is IT’S PEOPLE and the People’s current and future incomes known as taxes.
      * If a Lender can’t collect on “real” collateral, and they want and need the trillions of dollars that they’ve lent the borrower, then they’re going to “collect” from the borrower in one way or another.
      * AND, if the “middle man” who brokered the loan from the lender to the borrower is EVIL and is working for the lender, the borrowers are really “screwed!”

      * President Obama just changed strategies for our military, he’s moving troops and assets to ASIA!!
      * President Obama states that these moves are to “protect” American’s security (the normal propaganda).
      * China is investing trillions in a massive build-up of it’s military… troops, weapons, AND AIRCRAFT CARRIERS!

      THE “WHAT IF” HYPOTHESIS:
      * What if, the US Troops being deployed to Asia ARE NOT there to protect the US from China BUT, THEY’RE GOING THERE TO HELP CHINA BRING TROOPS TO THE US OR, ANOTHER “FALSE FLAG” EVENT!
      * The Lender aka China wants it’s money, the borrower aka the American Citizens via the evil Federal Reserve, can’t pay the loans because the US IS FLAT BROKE (only $2.7 trillion in income and $3 trillion in expenses and most money goes to paying bills in America).
      * So, the Lender is going to TAKE the next best thing, the land and the people of America!
      * China has an army of 100 million!!!!!
      * America has the military BUT, if they are ordered by Pres Obama, via a Presidential Executive Order, to help China, then they will do that.
      * There are 100 million American citizens that have guns (just the registered ones and doesn’t count all the rest) but, that’s not enough to fight China PLUS OUR OWN MILITARY!

      SOUND CRAZY? SOUND RIDICULOUS?
      * So was 9-11 (false flag event), so was Pearl Harbor (false flag event) and hundreds of other events in history until you look at the facts and see how those events came about!
      * It’s so easy to “sway” the opinion of the “masses” with created events!

    This is brilliant. When you want to convince ppl who clearly don’t care how their selfish actions might hurt the rest of the world to stop, what do you do? You tell ‘em that they’ll suffer as a result of their actions ’cause clearly all they care about is themselves.

    Only problem is, greed is like an addiction. An alcoholic won’t stop drinking–even after his friends&family have left him, his boss fired him &he’s begging on the street. Alcohol becomes a comfort to him then. Similarly, the greed-addicted won’t stop their greedy, selfish ways ’cause they’re addicted.
